BASile Import Customs Specialists is a Wisconsin-based company providing import classification and binding ruling services to individuals, importers, and manufacturers who plan to import merchandise into the United States. The use of the services provided by BAS.I.C.S. meets the “Reasonable Care” guidelines required by U.S. Customs. Under the Mod Act, importers who fail to exercise “reasonable care” when importing goods into the United States will be deemed to have acted negligently, and are subject to possible increased duties and monetary penalties.


On December 4, 1997, Customs published a “reasonable care” checklist as part of its informed compliance program to help and encourage importers to establish and maintain reasonable care procedures. In the preamble, Customs states “that the checklist is not an attempt to create a presumption of negligence, but rather, an attempt to educate, inform, and provide guidance to the importing community.” Although the checklist is neither exhaustive nor has the force of law, it includes a wide range of general, commodity, and transaction-specific questions, as well as questions for those involved with special trade programs or with trade-sensitive products such as textiles. All importers are encouraged to periodically review the checklist as part of an overall internal compliance program.

The Harmonize Tariff Schedule of the United States is sometimes difficult to decipher for an individual, importer, and/or manufacturer. A misconception of importers is that all brokers who process their shipments through U.S. Customs understand compliance issues. Specialized education and training are required to correctly classify imported goods. In an attempt to prevent Customs penalties, BAS.I.C.S. will cater to these needs and develop strong customer relations.
